TERMS AND CONDITIONS

A student must be fifteen (15) years of age or older to attend a driver education course. If the student is under 18 years of age a parent or legal guardian must approve the TERMS AND CONDITIONS contained herein. Students must fully understand and acknowledge that there are DANGERS AND RISK OF INJURY, DAMAGE OR DEATH that exist in the use of automobiles and automobile equipment in this driver's education course.

Participation in this course requires physical stamina, motor coordination, and physical alertness. The undersigned hereby attests that he/she has no known physical or mental limitations and has not used any form of alcohol, prescription or nonprescription drugs that could impair his/her performance in this course. Participants under 18 years of age must have this form approved by a parent or guardian. Brown's instructors have the final say regarding the conduct of students in both classroom and car.

Brown's Driving School (A & D Enterprises Inc.) agrees to provide the student who enrolls in its state certified driver education course with the services noted on the Brown's website related to the package chosen. Tuition for the complete course of driver training is listed in the Fees section of the Brown's website and must be paid in full on the first day of class. The tuition for the course is non-refundable and non-transferable. The contract serves as a receipt. The student must complete all hours of training and pay all fees in full prior to the issuance of a completion certificate. The returned check fee is $35.00. In the event that additional driving time is needed, the fees will be based on the current Fee Schedule on Brown's website. Cancellation of drive times must be made at least 24 hours before the scheduled drive or the student will be charged $40.00 for a cancellation not made before the 24­hour period,­ without exception. The student has one (1) year from the first day of class to complete the driver's education course. A reinstatement fee of $70.00 will be charged for finishing the program after the one (1) year time period. Ultimate Package students may complete drives #4 and #5 after 1 year with no reinstatement fee.

Policies regarding all Packages: When the student registers for the class he plans to attend, he will be allowed to select the Package that best meets his needs. Payment can be made online when registering, or on the first day of class. Students receive a completion certificate when the 10 hours class and 6 hours driving are completed even though more drives may be scheduled. Once a package is paid for, the fee is not refundable, and the package cannot be reduced to a lesser package even if some services are not used. Any or all of the package services cannot be transferred to another student. Parents are required to bring the student to Brown's office for The third drive and test, the prep drive and test, or the driving test. This allows Brown's to maximize practice for the test. Students doing the Basic Package can still purchase Extra Drives, Prep Drive, and Test.

In consideration of Brown's Driving School, A & D Brown Enterprises, Inc., including their members, employees, officers, and/or agents furnishing services, equipment and/or curriculum which enables students to participate in the Driver Education Course, I AGREE AS FOLLOWS:

I fully understand and acknowledge that: (a) there are DANGERS AND RISK OF INJURY, DAMAGE OR DEATH that exist in my use of automobiles and automobile equipment and my participation in the Driver Education Course activities; (b) my participation in such activities and/or use of such equipment may result in injury or illness including but not limited to: BODILY INJURIES, DISEASE, STRAINS, SPRAINS, FRACTURES, PARTIAL AND/OR TOTAL PARALYSIS, OTHER AILMENTS THAT COULD CAUSE SERIOUS DISABILITY, OR DEATH; (c) these risks and dangers may be caused by the negligence of the Driver Education Providers, the negligence of others, including the Driver Education Course participants, and may arise from foreseeable or unforeseeable causes, and (d) by participating in these activities and/or using the equipment, I, on behalf of myself, my personal representatives and my heirs, hereby assume all risks and all responsibility, and agree to release the Driver Education Course Providers for any injuries, losses and/or damages including those caused solely or in part by the negligence of the Driver Education Course Providers, or any other person.

I agree and understand that on behalf of myself, my personal representatives and my heirs, I am relinquishing any and all rights I now have or may have in the future to sue the Driver Education Course Providers for any and all injuries, damage or death that I may suffer arising from the use of automobiles or automobile equipment, including claims based on the Driver Education Course Provider's negligence.

I have read this release agreement and it is my intention to assume all risks and release the Driver Education Course Providers from liability for my personal injury, property damage or wrongful death caused by negligence or any other cause. I have had the opportunity to ask any questions about the above waiver and release and I understand its terms and meaning.

In consideration of Brown's Driving Schools, A & D Brown Enterprises, Inc., including their members, employees, officers, and/or agents, furnishing services, equipment and/or curriculum to enable me to participate in the Driver Education Course, I AGREE AS FOLLOWS:

I, on behalf of myself, my personal representatives and my heirs, agree to hold harmless, defend and indemnify the Driver Education Course Providers from any and all claims, suits or causes of action by others for bodily injury, property damage, or other damages which may arise out of my use of automobiles and automobile equipment or my participation in the Driver Education Course activities, including claims arising from the Driver Education Course Providers' or any other party's negligence. It is acknowledged that this indemnification language is clear, concise, and unambiguous and not unduly burdensome. It is also acknowledged that Brown's Driving School would not agree to the terms of this agreement unless such indemnification is granted by student and parent or legal guardian and that the same is an integral part of this agreement. Student and parent or legal guardian are responsible for any vandalism to automobile, classroom, or materials. Brown's Driving School is not responsible for the future driving performance of students enrolled in this program.

I have read these TERMS AND CONDITIONS and by signing I agree it is my intention to accept legal responsibility and pay for any loss for claims or lawsuits against Driver Education Course Providers arising from my participation in the Driver Education Course. I have had the opportunity to ask any questions about the indemnification and hold harmless section and I understand it's terms and meaning. If I am under the age of 18 years my parent or legal guardian has read and agrees with these TERMS AND CONDITIONS.
